Terms & conditions

The following are the Terms & Conditions that apply to the provision of training services (“the Services”) by Newset Training (“we” or “us”). By placing your booking with us, you confirm your acceptance of these Terms & Conditions, which will apply notwithstanding any other terms that you may specify.


The Services

1.1 Details of services will be agreed with the client at the time of booking and will be outlined on the booking form.

It is your responsibility to ensure premises and / or equipment that you provide for the purposes of the Services comply with all relevant health and safety requirements and are suitable for the course booked.


Training Materials/Course content

2.1 Any resources used or provided on the day or through the Newset Training website must not be reproduced or reused without prior written consent from us. Copyright and all other Intellectual Property Rights belong to Clare Martin, trading as Newset Training.

2.2 Newset Training reserves the right to use the same course with a multitude of clients. Development of courses specifically for a client still remain the intellectual property of Newset Training and therefore can be used by Newset Training for marketing, promotion and as repeat events for other clients in the future.


Fees and Payments for In House Training

3.1 Fees for delivery of a course are agreed at the time of booking and will be confirmed on the booking form. Additional fees include travel, accommodation and subsistence costs, which may apply if the booking is over 100 miles from LL57 4YS.

3.2 Travel costs if applicable are calculated at 45p per mile from LL57 4YS for travel by car. Or if alternative methods of transport are used actual costs will be charged. Accommodation costs will be based on individual hotel bookings and will include reasonable subsistence costs dependent on location conditions, applicable at the time.

3.3 All payments must be made within 28 days of the date of the invoice. We reserve the right to charge interest on late payment at 5% p.a. above the Bank of England Base Rate.

3.4 Delegate numbers will be agreed at the time of booking. We reserve the right to subsequently invoice an additional charge per person where numbers have been exceeded without prior discussion with us. This will be calculated per additional delegate based on the agreed price divided by the agreed number of delegates.



Fees and Payments for In House Training

3.5 Delegates must provide contact details for the organisation so an invoice can be sent. The booking is not confirmed until payment is received.



Cancellation

4.1 Cancellations or changes to courses can be made more than 90 days in advance of the booked date with no fee. However, cancellations made between 90 and 60 days before the course are subject to 50% of the course fee. From 60-30 days is 80% and less than 30 days requires the full fee to be paid.

4.2 Rescheduling is by agreement with Newset Training and a new booking form, setting out any administrative charges, will be issued.

4.3 In the event that Newset Training is unable to fulfil an engagement any fees already paid will be refunded unless it is possible to reschedule the course to a mutually convenient time for both parties. We will not however, be liable for any further costs associated with the cancellation of the booking. If you are attending a course with us at an external venue you are advised not to make travel plans more than two weeks prior to the course. Cancellations due to low numbers will happen two weeks prior.


These Terms & Conditions set out our entire responsibility in relation to the Services. All warranties, conditions, or other terms implied by statute or common law are excluded to the fullest extent permitted by law. Under no circumstances shall we be liable for any consequential loss or damage (whether for loss of profit, loss of goodwill, emotional distress or otherwise) resulting from the provision of the Services. No waiver by us of any of these Terms & Conditions shall be considered. These Terms & Conditions are not intended for the benefit of any third parties and the provisions of the Contracts (Rights of Third Parties) Act are hereby excluded. These Terms & Conditions shall be governed and construed in accordance with English law and the Courts of England and Wales shall have exclusive jurisdiction in relation thereto.
